OFFICIAL RULES

NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN, NOR WILL MAKING A PURCHASE INCREASE YOUR CHANCES OF WINNING.

ENTRY OPEN ONLY TO LEGAL RESIDENTS OF ONE OF THE FORTY-EIGHT (48) CONTIGUOUS UNITED STATES OR THE DISTRICT OF COLUMBIA WHO ARE AT THE AGE OF MAJORITY IN THEIR JURISDICTION ON THE DATE OF ENTRY. MINORS WHO ARE GUESTS OF THE POTENTIAL PRIZE WINNER MUST HAVE A TRAVEL COMPANION LIABILITY RELEASE WAIVER SIGNED BY A PARENT OR LEGAL GUARDIAN. VOID IN ALASKA, HAWAII, PUERTO RICO, ALL U.S. TERRITORIES AND POSSESSIONS, AND WHERE PROHIBITED BY LAW.

Timing: 4th of July Online Scavenger Hunt (the “Sweepstakes”) is presented by “Sweepstakes Administrators” : McMullin Injury Law. The Sweepstakes begins at 12:00:01 a.m. Eastern Time (“ET”) on Thursday, June 18, 2020, and ends at 11:59:59 p.m. ET on Monday, July 6, 2020 (the “Promotion Period”). McMullin Injury Law’s computer is the official timekeeping device for this Sweepstakes.

Eligibility:  To enter the Sweepstakes, the Participant (“you,” or “Participant”) must be a legal resident of one of the forty-eight (48) contiguous United States or the District of Columbia who is at least the age of majority in his/her jurisdiction as of the date of entry. Additional eligibility requirements are provided in these Official Rules. Officers, directors, employees, representatives and agents of the sweepstakes administrators (collectively, the “Released Parties”), and the immediate family members (parent, spouse, child or sibling, and their respective spouses, regardless of where they reside) of the officers and/or directors, and those living in the same households as the officers and/or directors, whether or not related, are not eligible to enter or win a prize. Void in Alaska, Hawaii, Puerto Rico, all U.S. Territories and Possessions and where prohibited or restricted by law, rule or regulation. All applicable federal, state and local laws apply.

How To Enter: There are two (2) ways to enter:

1)    Online Method of Entry: To enter the Sweepstakes via the online method of entry, an entrant is required to (1) fully complete the online scavenger hunt hich begins at: https://stgeorgeutahattorneys.com/fourth-of-july-2020-online-giveaway/ and ends upon seeing our confirmation message after successfully completing all related puzzles; AND (2) post a comment on the thread of our contest announcement post on either Facebook or Instagram; AND (3) like and/or follow McMullin Injury Law on either Facebook or Instagram; AND IF SELECTED (4) provide proof (valid gov. issued photo i.d. showing date of birth) that entrant had reached legal age of majority in his or her state of residence prior to their entry into this sweepstakes. A would-be winner who is selected but who is unable to provide proof in the form of the above-described manner before July 15th, 2020 will be deemed ineligible and a new winner will be selected.

2)    Mail-in Method of Entry: To enter without completing the online scavenger hunt, hand-print on a piece of paper your complete name, address, city, state, postal code, daytime phone number, and email address if you have one. Mail each entry in separate envelope with first class postage affixed, to: 4th of July Online Scavenger Hunt, 301 N. 200 E., Suite 3C, St. George, UT 84770. Each entry must be in a separate hand addressed envelope, postmarked by July 1, 2020 and received by July 6, 2020. No mechanically reproduced or photocopied entries are permitted. No mechanically reproduced entries will be permitted.  You may use the mail-in option as often as you like, but each entry must be hand-printed and mailed separately. Neither Sponsor nor Sweepstakes Administrator assume any responsibility for lost, late, incomplete, illegible, damaged, misdirected or postage-due mailed entries.

Limit: one (1) entry per person, regardless of method of entry, will be allowed. Any individual who attempts to enter, or in the sole discretion of Sponsor is suspected of entering more than once or submits entries in excess of the disclosed maximum, by any means, including but not limited to establishing multiple email accounts, will be disqualified from participation in this Sweepstakes. In the event of a dispute over the identity of the potential winner, the entry will be declared made by the authorized account holder of the email address submitted at the time of entry, and the potential winner may be required to provide identification sufficient to show that he/she is the authorized account holder of such email address.

Privacy: Collection and use of personally identifiable information and other records will be used according to the Utah Rules of Professional Conduct from the Utah State Bar. Those who submit entry are requesting contact and additional information from the Sweepstakes Administrators. All Entrants will be contacted by representatives of McMullin Injury Law. If you do not wish to be contacted, do not fill out the online form. You can still enter the sweepstakes by using the mail-in method of entry. Information will not be shared with any other parties outside of McMullin Injury Law.

Prize Drawings/Odds: Winner will be selected in a random drawing from among all eligible entries received, under the supervision of the Administrators and at least one unaffiliated eye-witness, on or about July 7, 2020. Odds of winning will depend on the total number of eligible entries received.

Winner Notification: Potential Prize Winner will be notified by phone and/or email. If the winner cannot be notified for any reason, his or her prize may be forfeited and awarded to an alternate winner. The potential Prize winner is subject to eligibility verification and compliance with these Official Rules. The Administrator will attempt to notify the potential Prize Winner via email within two (2) business days of the drawing using the email address provided at time of entry. In the email notice, the Administrator will provide all necessary documentation that the winner must execute before being entitled to be the confirmed winner, and redeem their prize. The Prize winner will be required to execute and return within seven (7) days of written notification an Affidavit of Eligibility, (a police report- if applicable), a Liability Release, and, where legal, a Publicity Release (collectively, the “Release Documents”), and an IRS form W-9. Travel guest and/or legal guardian of travel guest, must complete and return a Liability/Publicity/Travel Release prior to travel prior to issuance of travel documents. Minors who are travel companions must have a Travel Companion Release document signed by a parent or legal guardian.

Non-winning entries will not be notified.  Acceptance of any prize constitutes permission for the Sponsor and its designees to use winner’s name and likeness for advertising and promotional purposes without additional compensation unless prohibited by law. Failure to complete and return the documents in the time noted or if prize notification is undeliverable will result in disqualification and an alternate winner may be selected and notified. Winning a prize is contingent on fulfilling all the requirements set forth herein. Winner is responsible for all federal, state, local and income taxes associated with winning prize.Prize Winner will be required to furnish his/her social security number for the sole purpose of preparation of any tax forms as required by law.

Grand Prize and Prize Conditions:

Grand Prize: $5,000.00.  Except where otherwise expressly noted in these Official Rules, the selection of all vendors, prizes, products and services is subject to the Sponsor’s sole and absolute discretion. Prize (and/or any portion thereof) is non-transferable and non-exchangeable. No substitutions apply. Additional restrictions may apply. All other travel expenses not specifically mentioned herein, including but not limited to telephone, food and beverages, gratuities, and taxes, are the sole responsibility of the Winner and his or her Guest(s). All costs and expenses not expressly specified in these Official Rules are the sole responsibility of the Prize Winner.  The Prize is non-transferable.  No substitution, cash redemption, assignment or transfer of a prize is permitted, but the Sponsor reserves the right to substitute a prize of equal or greater value in the event that an offered prize is unavailable for any reason.

Conditions and Limitations:  All entries become the property of the Sponsor, who reserves the right to substitute a prize of equal or greater value. No substitution cash equivalent for any prize is offered, except at the sole discretion of the Sponsor. In no event shall more prizes be awarded than the number stated in the “Grand Prize and Prize Conditions” section above. By entering, each Participant agrees to hold harmless and indemnify the Released Parties, which includes McMullin Injury Law, PLLC, attorneys Anthony McMullin & Andrew Spainhower,  and the sponsors, against any and all liability, damages or causes of action (however named or described) due to any injuries, theft, damages or losses to any person (including death) or property of any kind resulting in whole or in part, directly or indirectly, from acceptance, receipt, possession, use or misuse of any prize or participation in any Sweepstakes-related activity or participation in this Sweepstakes, including any travel related thereto. All prizes are awarded “as is” with no at-law or implied warranties whatsoever. By participating in this promotion, participants agree to be bound by these Official Rules and the decisions of the Sponsor and the Administrator. The use of a script, macro, or automated or mechanical devices (or any other devices intended to automate or subvert any aspect of participation) to participate is prohibited and all such entries will be void. If Sponsor, in its sole discretion, determines that a Participant has used an automated, mechanical or similar device to participate or is in violation of these Official Rules, all entries from that Participant or email address or mobile phone number will be void. The Released Parties are not responsible for any incorrect or inaccurate information, whether caused by website users or by any of the equipment or programming associated with, or utilized in, this Sweepstakes or by any technical or human error that may occur in the processing and/or transmissions in the Sweepstakes. Sponsor assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries. Sponsor is not responsible for any problems or technical malfunction of any telephone network or lines, computer online systems, servers or providers, computer equipment, software, failure of email due to technical problems or traffic congestion on the Internet or at any website or combination thereof, including injury or damage to Participant’s or to any other person’s computer related to, or resulting from, participating in or downloading of materials in this Sweepstakes. If, for any reason, the Sweepstakes is not capable of running as planned, including, without limitation, infection by computer virus, bugs, worms, tampering, unauthorized intervention, fraud, technical failures or any other causes beyond the reasonable control of the Sponsor that may corrupt or affect the administration, security, fairness, integrity or proper conduct of this Sweepstakes, Sponsor reserves the right at its sole discretion to cancel, terminate, modify or suspend the Internet portion of the Sweepstakes and select winners from all non-corrupted eligible entries received up to the time of termination.

CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE THE WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THIS GAME IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND, SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES (INCLUDING ATTORNEYS’ FEES) AND OTHER REMEDIES FROM ANY SUCH PERSON(S) RESPONSIBLE FOR THE ATTEMPT TO THE FULLEST EXTENT PERMITTED BY LAW.

Disputes: Except where prohibited by law, all disputes concerning this promotion will be governed by and construed in accordance with the laws, rules and regulations of the state of Utah, without regard to its choice of laws or conflict of laws provisions. Entrants consent to the jurisdiction and venue of the Federal or state courts for Washington County, Utah.
