This case involved a client who was rear-ended in Cedar City. The client’s medical bills were over $2,400, but the insurance company only offered a settlement of $2,400. This was a lowball offer, and we knew it wasn’t fair to our client.

Initially, the clients were hesitant to hire an attorney, hoping the insurance company would simply do the right thing. This is a common hope, but unfortunately, it’s often not the reality. The initial offer, which didn’t even cover their medical bills, is a classic tactic used by adjusters to minimize their payout. They test the victim’s resolve, hoping they will give up and accept an unfair amount out of frustration. This is precisely the point where legal intervention becomes critical.

After we haggled with the insurance company, they saw that our client was a credible witness and that we were prepared to go to trial. Shortly after the deposition, the insurance company offered to settle the case for $10,300. This was a much fairer offer, and our client was happy to accept it.

Personal injury cases come in all shapes and sizes. At McMullin injury law, the biggest case that we resolved in the month of July, 2025, was actually a really devastating case. In order to get an insurance company to cough up a huge amount of money, it means something really bad has happened. The biggest settlement that we had at our firm in the month of July was $4.3 million, and unfortunately there was a rear end accident on the freeway to a beautiful family and the details of it are just too sensitive to go much further than that, but we were able to get a policy limits resolution of $4.3 million for this family.

By contrast, our smallest case in the month of July was also a rear end accident, but it happened here in Cedar City. It was a rear end on Main Street, there was minimal injuries. Their neck and back were sore, and they never wanted to hire an attorney at all. Actually never had before, but the insurance company that was at fault was offering ’em $2,400 to settle their case. And their medical bills alone were $4,700, so that was not gonna work. So they finally relented and called an attorney.

We were able to get their offer up to $6,300, but that still didn’t make sense. They were only getting $1,600 for the human experience of it, plus getting all their medical bills paid. So, that’s obviously better, but not enough. We ended up actually having to file a lawsuit because the insurance just refused to do what’s right.

After filing a lawsuit, taking depositions, showing the insurance company that we were serious, suddenly they offered 10,300 and we were able to get the case resolved for that family.
