Largest January Settlement: $600,000+ for a Young Woman Rear-Ended on Bluff Street
Our largest settlement in January was over $600,000.
This case involved a young woman who was driving northbound on Bluff Street, stopped at a red light near Sunset. A vehicle behind her failed to stop and rear-ended her at a high rate of speed.
The crash caused multiple serious injuries, including:
A broken arm (a severe fracture)
A torn rotator cuff
Serious low back injuries
Bulging discs
Pinched nerves
Radiating numbness and tingling into her legs
These injuries were not minor. They required extensive medical treatment, including multiple surgeries.
In total, she needed surgery for:
Her broken arm
Her rotator cuff
Her low back injuries
She was also out of work for nearly a full year.
Her medical bills alone were over $400,000, largely due to the cost of surgery and long-term treatment.
The Hidden Damage: How Injuries Affect Your Life Beyond Medical Bills
In serious injury cases, the damage goes far beyond hospital bills.
This crash had a major impact on her life. For example:
She had to drop out of college for a semester
She could no longer go to the gym the way she used to
Her confidence dropped
Even after treatment, she still didn’t feel the same as she did before the crash
This is the part of injury cases many people don’t understand at first: the law recognizes that you’re not just paying bills — you’re living through pain, limitations, emotional stress, and life disruptions.

How We Recovered Over $600,000 When the At-Fault Driver Only Had $100,000 in Coverage
One of the most important lessons from this case is how insurance coverage works in Utah.
The driver who caused the crash only carried $100,000 in liability insurance — even though the damages were far greater than that.
That means we could only recover $100,000 from the at-fault driver’s insurance company.
But this client had something that made a major difference.
Underinsured Motorist Coverage (UIM)
Our client carried UIM coverage, which stands for Underinsured Motorist coverage.
UIM can apply when the at-fault driver’s insurance is not enough to cover the full value of your injuries.
Because she had UIM coverage, we were able to recover an additional $500,000, bringing her total recovery to over $600,000.
This is exactly why we strongly encourage drivers in Southern Utah to review their insurance policies. Many people don’t realize how critical UIM coverage can be until it’s too late.
Smallest January Settlement: $9,500 for a Side-Swipe Crash Near Hurricane Walmart
On the other end of the spectrum, our smallest settlement in January was $9,500.
This case involved a woman in her 40s driving near the Hurricane Walmart.
The road was a single lane. She was preparing to make a right-hand turn into the Walmart parking lot when the driver behind her became impatient.
Instead of waiting, the driver attempted to pass her by driving onto the shoulder — then sideswiped her as she turned.
Thankfully, this crash was not severe. It wasn’t a terrifying collision, and she did not suffer major injuries.
However, she did experience minor injuries that required treatment. She needed approximately $5,700 in chiropractic care to return to normal and feel better.
Even Small Injury Cases Can Get Complicated
What made this case important is what happened next.
The at-fault driver’s insurance company — GEICO — initially tried to blame our client for the crash and avoid paying.
This is common in “smaller” cases. Insurance companies often assume people won’t fight back, especially when injuries aren’t catastrophic.
But fault still matters, and medical treatment still matters.
By pushing back and proving the case, we were able to get the claim resolved for $9,500.

I’m Andrew Spainhower with McMullin Injury Law, and at our firm we handle cases both big and small, and all through that spectrum. I’m gonna give you a couple examples of some cases that we handled in the month of January.
The biggest settlement that we reached in the month of January with an insurance company was for $600,000. It was for a young woman who was going northbound on Bluff Street, and stopped at a red light to go to Sunset. Unfortunately, the car behind failed to stop and rear-ended her quite hard and caused some pretty serious injuries. Broke her arm, tore her rotator cuff, and most importantly, caused some severe low back injuries, including bolting discs, and pinched nerves that required surgery in order to try to alleviate some of her symptoms. She had radiating numbness and tingling in her legs. Things that come with low back injuries. She also had to get surgery for the rotator cuff and for the broken arm that was a pretty severe break. She was out of work for almost a year. I think her medical bills ended up being over $400,000, mostly because she got three different surgeries. A case like that is a really big deal, obviously, and is gonna make a big impact on this young girl’s life. She, for example, dropped out of college for a semester, wasn’t able to make it to the gym, and her self-confidence dropped. She still doesn’t fill as well as she once did.
Prior to getting hit on a case like that, we got all the policy limits available. There was only a hundred thousand dollars on the car that hit her. That’s all they were insured for, even though they caused much more than that in damage. But, luckily she was carrying UIM coverage and was able to get an additional 500,000. So, we were able to collect for a total of a little over $600,000 to compensate her for that type of a case.
By contrast, some cases are really small, not as big of a deal. One example is there’s a woman in her forties that was driving near the Hurricane Walmart. There’s only one lane on that street. She’s gonna make a right hand turn into the Walmart parking lot and a car behind her gets impatient, goes into the right hand shoulder, and is trying to pass her to get into Walmart before her. She doesn’t see her ’cause you wouldn’t even check in the shoulder, moves over to make her right hand turn, and the two sideswiped.
It wasn’t a crazy, scary crash. She was okay, but she did suffer some minor injuries from that. She required about $5,700 in chiropractic care to get feeling back to normal. Initially Geico on the at-fault car, tried to blame our driver for the crash and get out of the claim. By saving that money, we were able to end up settling that one for $9,500.
